1. The Service
AdFactory is a software service that generates marketing images and videos ("Outputs") from product information and photos you provide ("Inputs"), using artificial intelligence models, some of which are operated by third-party providers.
The Service is in early access. Features may change, be limited or be interrupted while we improve it.
2. Accounts
- You must be at least 18 and able to enter a contract. If you use AdFactory for a company, you confirm you may bind it.
- Keep your login details secure. You are responsible for activity on your account.
- One free trial per person or business. Creating several accounts to obtain more free credits is not allowed.
3. Credits, plans and payment
- Generating content uses credits. The exact cost is shown before each generation.
- Free trial: 16 credits, valid 7 days, once per account.
- Subscriptions: Starter at $29/month for 100 credits; Growth at $79/month for 300 credits. Plan credits remain usable until the end of the billing cycle that follows the one in which they were granted, then expire.
- Top-ups: 50 credits for $19, available to subscribers, valid 12 months.
- Credits have no cash value, cannot be transferred and are not refunded when they expire.
- Subscriptions renew automatically each month until cancelled. You can cancel at any time from Plans & billing; cancellation takes effect at the end of the current period.
- Payments are processed by Stripe. Prices are in US dollars and may exclude taxes, which are added where required.
- We may change prices with at least 30 days' notice. Changes apply from your next billing cycle.

4. Your content
You keep all rights to your Inputs. You confirm that you own them or have every permission needed (including from any brand, photographer or person shown) to use them with AdFactory.
You give us a limited licence to host, process and transmit your Inputs and Outputs, including to our AI providers, only to run the Service for you. We do not use your Inputs or Outputs to advertise AdFactory without your permission.
5. Outputs
- Subject to these terms and to the rights of others, you may use your Outputs for any lawful purpose, including commercial advertising.
- AI output can be inaccurate. A generated image or video may differ from your real product (color, fit, details). You are responsible for reviewing every Output before you publish it and for making sure your advertising is truthful and not misleading.
- Similar Inputs can produce similar Outputs for other users. We do not guarantee that an Output is unique or that it can be protected by copyright.
- AI-generated people are synthetic. Do not present them as real customers or real testimonials. Follow the disclosure rules that apply to you (for example FTC guidance in the United States).
6. Acceptable use
You must follow our Acceptable Use Policy. We may refuse, remove content, suspend or close an account that breaks it, and we may stop a generation that we reasonably believe breaks it.
7. Third-party services
The Service relies on providers for hosting, authentication, payments and AI generation. Their availability is outside our full control. Importing a product from a store page fetches information that store makes public; you are responsible for having the right to use it.
8. Availability and changes
We aim to keep AdFactory available but do not promise uninterrupted service. A generation that fails for a technical reason is refunded in credits automatically. We may modify or discontinue features; if we close the Service, we will give reasonable notice and refund any unused prepaid period.
9. Liability
The Service is provided "as is". To the maximum extent allowed by law, we are not liable for indirect or consequential losses (such as lost profits, lost sales or advertising account restrictions), and our total liability for any claim is limited to the amounts you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot legally be limited, including your rights as a consumer where they apply.
You will indemnify us against claims arising from your Inputs, from content you publish, or from your breach of these terms.
10. Termination
You can stop using AdFactory and ask us to delete your account at any time by writing to support@tryadfactory.app. We may suspend or close accounts that break these terms. Sections 4 to 9 and 11 survive termination.
11. Law and disputes
These terms are governed by the laws of France, without prejudice to mandatory consumer protections of your country of residence. Before any claim, contact us at support@tryadfactory.app so we can try to resolve it. Otherwise, the courts of the publisher's registered office have jurisdiction, unless the law gives a consumer another choice.
12. Changes to these terms
We may update these terms. For material changes we will notify you by email or in the app at least 15 days before they apply. Continuing to use the Service after that means you accept them.
